Terms of Service

1. Acceptance of Terms
By accessing or using Hearth ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. We reserve the right to modify these Terms at any time, and your continued use of the Service constitutes acceptance of any changes.
2. Description of Service
Hearth is a writing application that provides tools for document creation, project organization, habit tracking, reminders, and optional AI-powered writing assistance. The Service may be modified, suspended, or discontinued at any time without notice.
3. Account Registration and Security
3.1 Account Creation
You must provide accurate and complete information when creating an account. You may register directly or use OAuth providers (Google, GitHub, Discord, Microsoft, Apple). You must be at least 13 years old to use the Service.
3.2 Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized access or security breach. We strongly recommend enabling two-factor authentication (2FA).
3.3 Account Termination
You may close your account at any time. We reserve the right to suspend or terminate your account for violations of these Terms, illegal activity, or abuse of the Service.
4. Subscription and Payment
4.1 Free Trial
We offer a 7-day free trial for new users. No credit card is required to start the trial. After the trial period, you must subscribe to continue using the Service.
4.2 Subscription Fees
Subscription fees are billed monthly or annually as selected. All fees are non-refundable except as required by law. We reserve the right to change our pricing with 30 days' notice to active subscribers.
4.3 Automatic Renewal
Subscriptions automatically renew unless canceled before the renewal date. You can cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period.
4.4 Payment Processing
Payments are processed by third-party payment processors. You agree to provide accurate payment information and authorize us to charge your payment method. Failed payments may result in service suspension.
5. User Content and Ownership
5.1 Your Content
You retain all ownership rights to the content you create, upload, or store in Hearth ("Your Content"). You are solely responsible for Your Content and the consequences of posting or publishing it.
5.2 License to Operate Service
By using the Service, you grant us a limited, non-exclusive license to host, store, and process Your Content solely to provide and improve the Service. This includes transmitting limited portions of Your Content to OpenAI's API when you use AI features.
5.3 Content Restrictions
You agree not to upload, share, or create content that:
- Violates any law or regulation
- Infringes on intellectual property rights
- Contains malware, viruses, or harmful code
- Is hateful, harassing, threatening, or abusive
- Exploits or harms minors
- Impersonates others or misrepresents your affiliation
- Contains spam or unsolicited promotions
5.4 Content Backup and Deletion
We maintain backups of Your Content for disaster recovery, but you are responsible for maintaining your own backups. Deleted content is soft-deleted for 30 days, after which it is permanently removed. We are not responsible for lost or deleted content.
6. AI Features and Usage Limits
AI-powered features are subject to:
- Rate limits and quotas to prevent abuse
- Availability and performance of third-party AI services
- OpenAI's acceptable use policies
- Optional nature—you can disable AI features at any time
We do not guarantee the accuracy, quality, or appropriateness of AI-generated suggestions. You are responsible for reviewing and editing all AI-generated content.
7. Acceptable Use
You agree to use the Service only for lawful purposes. You must not:
- Attempt to gain unauthorized access to our systems
- Reverse engineer, decompile, or disassemble the Service
- Use automated scripts or bots to access the Service
- Interfere with or disrupt the Service or servers
- Collect or harvest user data without permission
- Resell or redistribute the Service without authorization
- Use the Service to store or transmit illegal materials
- Abuse or circumvent usage limits, quotas, or rate limits
8. Intellectual Property
The Service, including its design, code, features, and trademarks, is owned by Hearth and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works from the Service without our express written permission.
9. Third-Party Services and Links
The Service integrates with third-party services (OAuth providers, OpenAI, payment processors, email services, etc.). We are not responsible for the content, privacy practices, or availability of these services. Your use of third-party services is subject to their own terms and policies.
10. Privacy
Your use of the Service is subject to our Privacy Policy, which explains how we collect, use, and protect your information.
11. Disclaimers and Warranties
11.1 Service "As Is"
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
11.2 No Guarantee of Availability
We do not guarantee that the Service will be uninterrupted, secure, or error-free. We may experience downtime for maintenance, upgrades, or unforeseen technical issues.
11.3 Data Loss
While we implement reasonable measures to protect your data, we are not responsible for any loss or corruption of Your Content. Maintain your own backups of important work.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HEARTH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.
13. Indemnification
You agree to indemnify and hold harmless Hearth, its affiliates, and their respective officers, directors, employees, and agents from any claims, losses, damages, liabilities, costs, and expenses (including legal fees) arising from: (a) Your Content; (b) your use or misuse of the Service; (c) your violation of these Terms; or (d) your violation of any rights of another party.

14.1 Informal Resolution

14.2 Governing Law
These Terms are governed by the laws of the jurisdiction in which Hearth operates, without regard to conflict of law principles.
14.3 Arbitration
Any disputes that cannot be resolved informally will be resolved through binding arbitration, except where prohibited by law. You waive your right to a jury trial and to participate in class actions.
15. Changes to Terms
We reserve the right to modify these Terms at any time. Material changes will be notified via email or a prominent notice on the Service. Your continued use after changes take effect constitutes acceptance of the modified Terms.
16. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
17. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Hearth regarding the Service and supersede any prior agreements.
